Lawyers have raised questions on the appointment of Judges and Magistrates Vetting Board Chairman Sharad Rao to head the tribunal to probe Justice Phillip Tunoi.
The 83 year old Rao was appointed by President Kenyatta on Tuesday to head the tribunal. Lawyers however, say that he cannot head the tribunal if he hasn’t been a judge of a superior court. Lawyers Edwin Sifuna and Boniface Muumbi, in separate interviews pointed out that Rao could only be a member and not the chair.
“Sharad Rao was not supposed to be appointed as a chair of the tribunal as he has never been a judge,” Mr Sifuna said.
